Colorado Sheriff refuses to enforce gun-control bills

GREELEY, Colo. (AP) — A Colorado sheriff says he won't enforce two aggressive gun-control measures waiting to be signed into law by Gov. John Hickenlooper.

Weld County Sheriff John Cooke told The Greeley Tribune (Cooke won’t enforce new state gun laws | GreeleyTribune.com ) that Democratic lawmakers are scrambling after recent mass shootings, and the bills are "feel-good, knee-jerk reactions that are unenforceable."

One bill expands background checks on firearm purchases, and the other limits ammunition magazines to 15 rounds. The 15-round magazine limit would make Colorado the first state outside the East Coast to ratchet back gun rights after last year's shootings in Aurora, Colo., and Newtown, Conn.

Colorado's gun-control debates have been closely watched because of the state's gun-loving frontier heritage and painful history of mass shootings, most recently last summer's movie theater shooting that killed 12.

The sheriff said he "won't bother enforcing" the laws because it would be impossible for officers to keep track of how the requirements are being met by gun owners — and he and other sheriffs are considering suing the state to block the measures if they are signed into law.

Cooke said the bill passed Friday requiring a $10 background check to legally transfer a gun wouldn't keep firearms out of the hands of those who use them for violence.

"Criminals are still going to get their guns," he said.

The sheriff's office did not immediately return calls left by The Associated Press.

The magazine-limit bill passed earlier in the week will technically ban all magazines because of a provision that outlaws any magazine that can be altered, he said, adding that all magazines can be altered to a higher capacity.

Expanded checks have been a top priority for Hickenlooper, who called for the proposal during his State of the State address in January.

Cooke oversees law enforcement in Colorado's third-largest county by area. His jurisdiction includes its largest city, Greeley, and large swaths of farmland and areas of oil and gas production.

DENVER (AP) — Colorado Gov. John Hickenlooper will sign legislation Wednesday that sets limits on ammunition magazines and expands background checks for firearms, marking a Democratic victory in a state where gun ownership is a treasured right and Second Amendment debate has played out in the wake of two mass shootings.

The measures proposed are some of the strictest gun laws in the nation, and their passage comes after weeks of tense legislative battles. Republicans and gun rights supporters put up a major fight against the measures in this politically moderate state, while Democrats made them the centerpieces of a package of legislative proposals drafted in reaction to shooting rampages at a suburban Denver movie theater and a Connecticut elementary school last year.

"I think it will make it more difficult for people to get guns who shouldn't have them, and that's really the goal," said Democratic Rep. Beth McCann on the expanded background checks.

Magazine limits would reduce gun violence and have an impact during mass shootings, because they would force gunmen to reload more times, she said. "It's an interruption in the spraying of bullets."

Hickenlooper spokesman Eric Brown confirmed Monday that the governor would sign the measures.

Colorado's gun controls, which become effective July 1, are the first beyond the East Coast approved this year. They also are getting approval as Congress embarks on its own gun debate in Washington, where Colorado Democrat's proposals were closely watched because the state was seen as a bellwether.

The Colorado laws include a ban on ammunition magazines that can carry more than 15 rounds, and eight shotgun shells. The bill on background checks expands the requirement to sales and transfers between private parties and online purchases.

Republicans reviled both bills and argued the proposals would not prevent more shootings, but hurt law-abiding citizens' exercise of their Second Amendment rights.

"We're obviously very disappointed. I think we demonstrated time and time again all of the issues associated with" the magazine limits, said Republican Rep. Mark Waller, the GOP leader in the House.

"They're doing this without any proof that banning this is going to have any impact on public safety," he said.

Republicans seemed resigned from the start that the bills would become law, though. Hickenlooper said previously he would sign the magazine limit, and he specifically asked the Legislature to expand background checks in his annual address.

"Our only hope now is if his pen runs out of ink," said a rueful Rep. Ray Scott, R-Grand Junction.

The governor also was planning to sign a bill reviving user fees for gun purchasers needing background checks. Colorado charged $10 background-check fees more than a decade ago, but the fees were dropped. The Colorado Bureau of Investigation currently picks up the tab checking prospective gun owners.

A Colorado-based magazine manufacturer said it would leave the state if the new restrictions were passed, taking hundreds of jobs with it. Democrats tried to ease the concerns from Magpul Industries, saying the company can still manufacture higher-capacity magazines if they were sold out of state.

Waller blasted Democrats on that amendment, saying it was hypocritical because they are telling the company "you can sell (magazines) at any other place where any of these tragic shootings have happened."

Waller called the exemption "a monumental inconsistency in their thought process."

Other Democratic gun control proposals still pending in the state Legislature include a ban on gun ownership by people accused of domestic-violence crimes and a bill to eliminate online-only safety training for people seeking concealed-weapons permits.

Two more Democratic gun control bills were withdrawn when they appeared to lack support for passage. Those included a new liability standard for gun owners and sellers, and a ban on concealed weapons on public college campuses.

Republican gun ideas were hastily rejected earlier this year. Those ideas included expanding gun laws to allow teachers to carry concealed weapons, and a failed attempt to require armed security guards at businesses that ban concealed weapons.

Landmark gun bills signed in Colorado

DENVER (AP) — The governor of Colorado signed bills Wednesday that put sweeping new restrictions on sales of firearms and ammunition in a state with a pioneer tradition of gun ownership and self-reliance.

The bills thrust Colorado into the national spotlight as a potential test of how far the country might be willing to go with new gun restrictions after the horror of mass killings at an Aurora movie theater and a Connecticut elementary school.

The approval by Gov. John Hickenlooper came exactly eight months after dozens of people were shot at the theater, and the day after the executive director of the state Corrections Department was shot and killed at his home.

The bills require background checks for private and online gun sales and ban ammunition magazines that hold more than 15 rounds.

Two ballot measures have already been proposed to try to undo the restrictions.

At the signing ceremony, Hickenlooper was surrounded by lawmakers who sponsored the bills. He looked around with a solemn expression before signing a measure requiring buyers to pay fees for background checks.

Each time he signed a bill, applause erupted from lawmakers and their guests, who included Jane Dougherty, whose sister was killed in the attack at Sandy Hook Elementary in Newtown, Conn.; Sandy Phillips, whose daughter was killed in Aurora; and Tom Mauser, whose son was killed in the 1999 Columbine shooting in Colorado.

Phillips, who lost daughter Jessica Ghawi, reminded Hickenlooper that it was the eight-month anniversary of the theater rampage.

"You've given us a real gift today," she told the governor.

Later, Phillips added: "Thank you so much. You're leading the entire country."

Dougherty thanked Hickenlooper with tears in her eyes. Mauser also expressed gratitude.

"I knew it would be a long haul," he said. "But I had faith in the people of Colorado."

Democratic Rep. Rhonda Fields, who represents the district that includes the theater, said the governor had signed "common-sense legislation that reduces gun violence in our communities by keeping guns out of the hands of criminals, domestic violence offenders and the seriously mentally ill."

The shootings led Hickenlooper and other state Democrats to take on the issue of gun control. They succeeded while members of their party stumbled in other states.

Washington state's Democrat-controlled House failed this month to pass a universal background check bill. A bill requiring background checks at gun shows in New Mexico also stalled in that Democrat-led Legislature.

The measures signed by Hickenlooper were the centerpieces of a package of gun bills introduced this session in Colorado.

Under the laws, gun sales and transfers between private parties and purchases conducted online will be subjected to background checks. Ammunition magazines that hold more than 15 rounds will be banned and subject to criminal penalties. Both bills take effect July 1.

Lawmakers debated firearms proposals after the Columbine High School shooting, and began requiring background checks for buyers at gun shows. But nothing they did then was as sweeping as the proposals they took up this year.

Republicans have warned that voters will punish Hickenlooper and other Democrats who voted in favor of the measures.

"I'm telling you, they have overreached, and there are going to be electoral consequences," said Republican Sen. Greg Brophy.

Republicans have said limiting magazine sizes will drive jobs from the state, and ultimately won't prevent criminals from getting larger magazines in other states.

One Colorado-based manufacturer of ammunition magazines disclosed plans to relocate because of the new restrictions.

Some county sheriffs opposed the new background checks, arguing the move is unenforceable and endangers Second Amendment rights.

I kinda seen this coming, when i took my C&C course Colorado was One of the only states who would NOT allow you to C&C in their state unless a permanent resident, which i find fairly strange.

Oklahoma law passed, 37 to 9 an amendment to place the Ten Commandments on the front entrance to the state capitol. The feds in D.C., along with the ACLU, said it would be a mistake. Hey this is a conservative state, based on Christian values...! HB 1330

Oklahoma recently passed a law in the state to incarcerate all illegal immigrants, and ship them back to where they came from unless they want to get a green card and become an American citizen. They all scattered. HB 1804. This was against the advice of the Federal Government, and the ACLU, they said it would be a mistake.

The federal Government has made bold steps to take away our guns. Oklahoma, a week ago, passed a law confirming people in this state have the right to bear arms and transport them in their vehicles. I'm sure that was a setback for the criminals The Liberals didn't like it -- But....Guess what........... Oklahoma did it anyway.

Just this month, the state has voted and passed a law that ALL drivers’ license exams will be printed in English, and only English, and no other language. They have been called racist for doing this, but the fact is that ALL of the road signs are in English only. If you want to drive in Oklahoma , you must read and write English. Really simple.
