The confirmation hearings for Brett Kavanaugh, President Donald Trump’s hopeful Supreme Court Justice nominee, were going to be a highly-contested affair no matter what happened. The testimony by Dr. Ford last week took it to a whole new level, and now, even Trump has had to pump the brakes a little bit and ask for a little more examination into Kavanaugh’s past. Now, it goes without saying that anytime you are talking about someone who may become a lifetime appointee to the most powerful and influential court in the land (and quite possibly the world), there is a lot at stake, but this case has more riding on it than usual.

We are asking dangerous questions. It is popular to say that Dr. Ford is brave for coming forward and we should all believe her because, as the now popular hashtag goes, we must #believesurvivors. The point of this article is not to debate whether this woman is telling the truth. That’s the thing. It doesn’t even matter if she is telling the truth or not. Why, you say? Because truth or no truth, there is no proof. And without proof, we are opening a powerful door for anyone out there to say anything they like about anyone.

It’s a touchy subject, and that’s how it got to be this way. Being accused of rape or some variation of sexual assault is one of those allegations that will ruin your existence whether it rises to a criminal situation or not. Kavanaugh is going to be tainted by this forever, even if no proof of his guilt ever comes up. No one has corroborated the story yet, and Ford’s testimony created plenty of questions as well as answers. If this was a court of law, this case would be thrown out. There is absolutely no physical evidence, it is long past the statute of limitations for criminal prosecution, and it would be impossible to convince a jury that Kavanaugh was guilty of anything beyond a reasonable doubt. And yet, he will pay a penalty. Whether he is confirmed or not, his achievements will always have that asterisk with the explanation of how he may or may not be a sexual predator. That is something that cannot be changed at this stage, barring a full recanting of Ford’s testimony, which is equally as unlikely. His name is smeared for good. That may be something he deserves, and it may not. That’s the problem.

Going into the political side of all this, there are even more dangerous implications. A lot of people that oppose Kavanaugh’s nomination use the very logical, decent argument that why would you want to take a chance on this guy if it even seems like he may have possibly been anywhere near a sexual assault. It’s a legitimate argument. In the private sector, it would make a lot of sense. I don’t know if he’s guilty, but I’ve got a huge stack of applications. Why stop here? The problem, as the Democratic side of Congress well knows, is that it opens the door to more of the same. Democrats are smart enough to realize that when they do get back in control of the White House and they do get to put up their own guy, Republicans will find women to come forward and do the same thing. That’s whether it is truthful or not. Kavanaugh could set a precedent that any allegation means immediate dismissal as a candidate. It’s hard to see how we would ever get a Justice confirmed in that climate. That is why the Democrats sat on this information and didn’t even themselves really want to go this route. This was a nuclear option with no turning back for them. Believe what you want to believe, but while they won’t vote for him on principle, many Democrats hope that they put up a good fight for their base but he gets confirmed. That way, the future is safe for more of the same. Situations like this make it seem like we are seeing a clear divide in our so-called two-party political system. Actually, you are watching firsthand collusion on a massive scale. They all know exactly what they are doing, and much of what you see if just song and dance for the public. Behind closed doors, they all know what the score is.
