Police trying to bust up an underage drinking party say they got more than they bargained for when they ran into an intoxicated mom, rowdy teens and a barricaded condo door.
Mixed among the scattered beer and liquor bottles across the floor, police said they found a girl, 16, choking on her vomit in a restroom. She was treated at St. Mary's Hospital.
It all happened as the 7-year-old son of the listed condo owner, Kimberly Clark Kiernan, 39, of Palm Beach Shores, was locked in a room during a Monday night party with 26 minors, according to a Palm Beach Shores Police Department arrest report.

Antonia Benitez, of Santa Ana, is accused of depriving her 4-year-old daughter of food and medical care. Benitez was arrested July 18, 2013, about six weeks after she left her daughter, weighing just 18 pounds, at a hospital.
After her 4-year-old daughter was dropped off at a hospital weighing just 18 pounds, an Orange County mother of nine is facing multiple counts of child abuse, authorities said.

Antonia Benitez, 35, of Santa Ana, was arrested Thursday, the Orange County District Attorney said.
She ran after leaving her daughter at a hospital June 4, according to the OC DA.

The 4-year-old girl was suffering from an infected wound on her leg and malnutrition, the OC DA said. Doctors at the time called Social Services which in turn alerted Santa Ana police.

In July 2012, Benitez allegedly took her daughter to the hospital for being underweight. That instance was not reported to police, the Orange County District Attorney said.

The average 4-year-old weighs about 34 pounds, according to the National Center for Health Statistics. Benitez’s daughter weighed about 18 pounds when she was taken to the hospital last month.

All nine of Benitez's children, ranging in age from 4 to 16, are under the care of Social Services or family members. Two fathers are connected with Benitez's nine children, but the 35-year-old mother was raising them on her own, police said.

The OC District Attorney has filed three counts of felony child abuse against Benitez.

She is being held on $250,000 bail, and is scheduled to appear in court Friday for an arraignment.

If convicted, Benitez faces a maximum sentence of 14 years and six months in state prison.

PHILADELPHIA -- Police said two men are being charged over a crash that killed a mother and her three young sons on a 12-lane highway plagued by pedestrian deaths.

Samara Banks often called a cab to take her and her four little boys home from family visits on the other side of Roosevelt Boulevard in Northeast Philadelphia, relatives said. But on Tuesday night, she thought temperatures had cooled down enough to walk the mile back home from her aunt's house.

Banks, 28, and her three youngest sons were killed as they crossed at a point with grassy medians dividing the traffic lanes, but no crosswalk or traffic light. Her oldest, a 5-year-old, survived with bumps and bruises.

"The cab service knows her well," said LaTanya Byrd, an aunt who described Banks as a devoted mother who had helped raise siblings after her own mother died. "Last night, it got a little cooler and she felt she could walk."

A police spokeswoman said Wednesday night that two men were being charged with four counts each of third-degree murder, homicide by vehicle and involuntary manslaughter. A witness reported drag racing may have been involved, she said. The two men also will face charges of recklessly endangering another person, aggravated assault, simple assault and aggravated assault by vehicle, police said.

Roosevelt Boulevard had the nation's 2nd and 3rd most dangerous intersections in a 2001 insurance company study, which tallied 618 crashes at those two intersections alone in a two-year period.

The speed limit is 40 mph where Banks and her boys were killed, but drivers frequently go 10 or 20 miles above that to make — or run — a light, neighbors said Wednesday. Many residents of the lower-income area don't have cars, and are left to traverse the boulevard on foot to get to schools, parks and stores.

Just hours after Banks and her boys died, Iris Rolon chose the same mid-block route to cross with her 10-year-old daughter and 8-year-old niece. They were walking to a city pool on the 95-degree day.

"It ain't safe, but I like to wait until I see that the light changes," said Rolon, who admits she once had a close call crossing the boulevard in her youth.
Police could not immediately provide more recent data on fatal or non-fatal accidents on the road, but news reports detail a few of them.

Last August, 43-year-old Michael Romano died after pushing his 5-year-old son out of danger just before he was struck by a hit-and-run driver at 11 p.m. His death came just days after another man was killed in a 2 a.m. hit-and-run nearby.

And 36-year-old pedestrian Brenda Rodriguez was struck and killed in June 2009 after she and a friend picked up Chinese food. Witnesses said she was struck as two drivers were racing each other; both of them fled.

They died even after police installed red-light cameras to try to calm traffic.

"Every time I cross the boulevard, I see somebody running the light. I think they don't know there's a camera there," said Angel Mendoza, 32, who lives a block away.

The young man being questioned in Tuesday's crash was driving a 2012 Audi, while the other car involved was a 1994 Honda, police said. They said charges are pending.

Banks had previously worked at a day care center, and her apartment was often the gathering spot for her large extended family, relatives said. They plan to bury her with her 7-month-old son in a cemetery plot just across the street, and bury her 23-month-old and 4-year-old together in an adjacent plot.

"She was a great parent," Byrd said. "When her mom passed, she just took over and got things done."

A 1-year-old girl died Thursday after she was left for hours in a parked car on a sweltering day in Homewood, Ala., NBC station WVTM reported.

Police said they received a call around 1:30 p.m. about a baby locked inside a vehicle. The temperature outside at the time was about 91 degrees, and the temperature inside vehicles can reach life-threatening levels quickly.

The girl was taken to the hospital, where she was pronounced dead.

Chris Conn told WVTM that he saw the mother panicking, ran over and performed CPR on the child, but it was too late. He said the child had been left in the car around 10 a.m.

So far this year there have been at least 21 deaths of children unattended in vehicles, according to a study from the Department of Geosciences at San Francisco State University. In 2012, that number was 33.

A couple from West Virginia have been arrested after police allegedly found their two young children handling and eating human excrement in their filthy home.

Michael Paul Perry, 28, and Crystal Sidney Perry, 19, were taken into custody after sheriff deputies found their children, aged one and two, held in a room covered in feces in Ashland.

McDowell County officers responded to the home on Thursday after a Child Protective Services worker tried to remove the children from the home but was met with resistance from the parents.

The CPS worker alerted officers that they were in need of immediate assistance at the residence.

When officers arrived, they met with the CPS worker, who showed them the deplorable conditions the children were allegedly living in.

According to the criminal complaint, the detective saw that the children were filthy and handling the human excrement.

'The room in which the children were being held had human excrement in the floor and that the children had been eating the excrement,' the complaint said.

Sheriff's Sgt. J.E. Muncy said the human waste 'was on candy that they were eating'.

The parents were arrested and charged with child abuse creating substantial risk of injury.

They were both arraigned in magistrates court and bond has been set at $100,000 each.

Both have been sent to the McDowell County holding unit and are awaiting transport to Southwestern Regional Jail.

In West Virginia, a charge of creating a substantial risk of serious bodily injury carries a sentence of one to five years in prison and a $3,000 fine.

A mom is facing assault charges after nearly pulling off her six-year-old son's genitals during a rage and then trying to repair his wound with superglue.

Jennifer Marie Vargas, 34, is a civilian living at Joint Base San Antonio-Fort Sam Houston in San Antonio, Texas, where the boy's father is in the Army.

She was arrested on Wednesday and has been charged by the FBI with assault within maritime and territorial jurisdiction resulting in serious bodily injury.

Vargas remains in custody pending a bail hearing on Monday in federal court in San Antonio and faces up to 10 years in prison.

The incident happened on Sept. 27 at the family's home at the military base.

Prosecutors say the father returned home from work and found his injured son crying in his bedroom.

The father noticed bloody tissue in the boy's underwear and the severe injury to his scrotum.

He took his son to the San Antonio Military Medical Center, where doctors found that the boy had a four centimeters long laceration to his scrotum and bruising to his penis area.

'Due to the child's extreme physical pain, the medical staff had to administer medication,' the affidavit said, reports the Houston Chronicle.

'The child was taken into surgery to repair the damage to his scrotum.'

The boy is currently recovering from surgery and remains in his father's custody.

Vargas, the affidavit said, admitted to agents that while angry with the boy she grabbed him by the scrotum and pulled him to her as hard as she could, 'thereby ripping his "sack" and causing a laceration.'

Vargas told FBI agents that she cleaned the wound with alcohol and then tried to fix it with superglue.

'She applied superglue to the (boy's) scrotum until the bleeding stopped, stuffed his underwear with paper towels, and then told him to go to bed,' the affidavit said.

'Vargas did not seek any type of medical treatment for the child.'

Vargas was not charged until now because the matter still was under investigation. She is currently being detained with bond and at Monday's bail hearing prosecutors will argue that she continue to remain jailed.

Federal investigators are looking at previous states where the couple have lived to see if there have been any prior interactions with child protection agencies, but the CPS said it hasn't dealt with the family before.

Three sisters who escaped after allegedly being held captive for two years by their mother and stepfather in Arizona were kept in filthy prison-like conditions and incarcerated using a complex system of locks and alarms, police said Wednesday.

The girls, aged 12, 13, and 17, said they were forced to listen to loud music 24 hours a day, seven days a week, which then turned to static if they showed any signs of enjoyment, according to police in Tucson.

The girls were allegedly monitored by surveillance cameras pointing at their beds, and they had to request to go to the bathroom. Police said if their mother and stepfather refused their requests to use the toilet, the girls were forced to use the closet.

Tucson Police Chief Roberto Villasenor said that air ducts were sealed off, vents were covered, and towels were kept under the doors, as if to sound-proof the rooms. Any attempt to escape would set off a shrill alarm.

"What the kids are telling us is that it was 24/7: Either loud music or…if they showed appreciation or enjoyment of the music it was turned over to static, and there would be loud static directed toward the beds," Villasenor told a press conference Wednesday. "Their movements were controlled -- when, where and how they went to the bathroom, when they were fed."

They were fed a goulash-like meal once a day and responsible for cleaning their own plates within the rooms, Villasenor added.

"[The accused couple] did things that made these girls feel isolated and made real sure they did not feel in control," he said.

The three sisters were discovered when the two youngest managed to escape the house in Tucson via a window early Tuesday. They ran to a neighbor and told them their stepfather kicked in their door and tried to attack them with a knife, according to police.

Villasenor told the press conference that the neighbors did not even recognize the sisters, and the girls did not know their own address.

When officers came to the girls' house they found the older sister locked in a separate room. All three were malnourished and had not washed properly for months, police said.

Fernando Richter is also charged with one count of sexual abuse of a minor, said Bernard Rivera, a Tucson City Court public safety support specialist.

In a statement to police, Sophia Richter denied that she or her husband abused the girls. She said they only disciplined them by taking away the television or music, NBC station KVOA reported.

The girls are being held in Child Protective Services, Pima County Lt. Chris Wildblood said.

Fernando Richter is on probation after pleading guilty to a DUI and possession of drugs in 2012, according to court documents.

He was arrested several times between 2002 and 2012 for disorderly conduct, assault, harassment and criminal damage, but charges were dismissed or allowed to expire each time, court documents revealed.

Fernando and Sophia Richter were being held in Pima County jail, with bond set at $100,000 and $75,000 respectively.

A Florida man was arrested after he left an infant inside a locked car in a Fort Myers strip club parking lot, police said.

Andrew Sosa, 21, was arrested on a child neglect charge after he left the four-month old girl inside a Kia Optima at Lookers strip club, according to NBC 2.

Fort Myers Police said an officer was flagged down after the baby was spotted in a car seat in the back of the vehicle just after 10:30 p.m. The officer couldn't find the car's owner so he smashed the window to get the baby out.

The baby was sweating and covered in vomit, and was taken to a nearby children's hospital for mild dehydration, NBC 2 reported. She is expected to be fine.

Detectives later discovered the baby girl had been left inside the car for three hours while Sosa was inside the strip club, police said.

Sosa, of Cape Coral, appeared in court Saturday, where his bond was set at $100,000. It was unknown whether he has an attorney.

The Department of Children and Families is handing the case.
