A lot is being made, especially in conservative circles, about John Kerry and something called the Logan Act. This is a statute that many point to as prohibiting a citizen from negotiating with a foreign government without the authority to do so. John Kerry’s recent attempts to communicate with the Iranians in a failed effort to keep the deal he helped broker alive is being pointed out as a clear violation of this act, which would make John Kerry essentially a traitor to America. We have included an informative video below about the Logan Act and what it is and what it isn’t so you can make up your own mind.

Like plenty of laws on the books, the Logan Act is outdated and unenforceable. No law organization would ever in a million years try to prosecute someone on these grounds. Yet, the law still exists for one reason and one reason only: for the government to pull it out and dust it off for special situations when it sees fit. This law is never used to actually charge someone with a crime. It is only ever used as a reason to investigate someone or push an agenda forward. Just recently, you can see that with several Trump associates in the Russia investigation. No one will ever go to prison because of the Logan Act, but it just may over their coffers to federal agents everywhere.
